Person responsible for content pursuant to Section 5 TMG (German Telemediengesetz): Mark Preier
(address as provided to the left)

Disclaimer and Data Protection Information Pursuant to the GDPR

1. Content of the Online Offer

The author assumes no liability for the topicality, correctness and completeness of the information provided on his website. Liability claims against the author relating to material or immaterial damage caused by the use or non-use of the information provided or by the use of incorrect or incomplete information are excluded, unless there is evidence of willful intent or gross negligence on the part of the author. All offerings are subject to confirmation and are non-binding. The author expressly reserves the right to change, supplement or delete parts of the pages or the entire offering without prior notice or to cease publication temporarily or permanently.

2. References and Links

This website contains links to third-party websites (“external links”). These websites are subject to the liability of the respective operators. When the external links were first established, the provider checked the external content for possible violations of the law. At that time, no violations of the law were apparent. The provider has no influence whatsoever on the current and future design and content of the linked pages. The inclusion of external links does not mean that the provider adopts the content behind the reference or link as his own. Constant monitoring of the external links is not reasonable for the provider without concrete evidence of legal violations. However, if we become aware of any legal infringements, such external links will be deleted immediately.

3. Copyright and Trademark Law

The author endeavors to observe the copyrights of the images, graphics, sound documents, video sequences and texts used in all publications, to use images, graphics, sound documents, video sequences and texts created by himself or to use license-free graphics, sound documents, video sequences and texts. All brands and trademarks mentioned within the Internet offering may be protected by third parties and are subject without restriction to the provisions of the applicable trademark law and the ownership rights of the respective registered owners. The mere fact that a trademark is mentioned shall not lead to the conclusion that it is not protected by the rights of third parties. The copyright for published objects created by the author himself remains solely with the author of the pages. Any duplication or use of objects such as diagrams, sounds or texts in other electronic or printed publications is not permitted without the author’s express agreement.

4. Data Protection

If the opportunity for the submission of personal or business data (e-mail addresses, name, addresses) is given, the submission of this data is strictly voluntarily. The use and payment of all offered services is permitted – if and so far technically possible and reasonable – without specification of any personal data or under specification of anonymized data or an alias. The use of published postal addresses, telephone or fax numbers and e-mail addresses for marketing purposes is prohibited; offenders sending unsolicited spam messages will be punished. I expressly reserve the right to take legal action against senders of so-called spam mails who violate this prohibition.

4.1 Information on Data Processing Pursuant to Art. 13 GDPR

4.1.1 General Information

The guarantee of data protection – the protection of your personal rights – is important to me. You will ensure to handle your data responsibly.

Pursuant to Art. 13 of the EU General Data Protection Regulation (GDPR), I would like to provide you with the information specified.

4.1.2 Name of the Responsible Entity

See above, Imprint / “Person Responsible for Content.”

4.1.3 Purpose and Legal Basis for Collection, Processing and Use:

The object of the website is to provide an impression of my artistic range and to connect with people interested in my works as well as other artists. The collection, processing and use of data are carried out for the purpose of fulfilling the stated objective.

The main purpose of the collection, processing or use of personal data is administration, communication, and, where applicable, service performance and invoicing.

If services are rendered, as a rule only data required for the provision of the services will be collected. Any data collected in addition is voluntary information. The processing of personal data takes place exclusively for communication and the fulfilment of the requested service and for the protection of justified own business interests.

4.1.4 Groups of Persons Concerned, Data and Data Categories:

The following categories of personal data are collected, processed and used in order to fulfil the purposes set out in point 4.1.3:

- Address data, contact data, billing and performance data

4.1.5 Recipients to whom the data can be communicated:

Data may be communicated to subsequent recipients:

- Public bodies receiving data under legal provisions (e.g. law enforcement agencies, public authorities)

- External contractors in accordance with Art. 28 GDPR (service companies)

4.1.6 Standard Period for Data Deletion:

The legislator has enacted a variety of storage obligations and periods. After expiry of these periods, the corresponding data and data records are routinely deleted if they are no longer necessary for the fulfilment of the contract. For example, the commercial or financial data of a completed fiscal year are deleted after an additional ten-year period in accordance with legal regulations, unless longer retention periods are prescribed or are necessary for legitimate reasons.

4.1.7 Planned Transfer of Data to Third Countries:

A transfer to third countries is not planned.

4.1.8 Rights of the Data Subject

If your personal data is being processed, you are the data subject within the meaning of the GDPR and you are entitled to the following rights vis-à-vis the person responsible:

You have the right to information about your personal data stored, about the purposes of the processing, about possible transmissions to other places and about the storage duration.

If data is inaccurate or no longer necessary for the purposes for which it was collected, you may request that it be rectified, deleted or limited. As far as provided for in the processing procedures, you can also view your data yourself and correct it if necessary.

Should your particular personal situation give rise to reasons against the processing of your personal data, you may object to processing of data that is based on a justified interest. The controller will no longer process the personal data relating to you unless he can prove compelling reasons for processing worthy of protection that outweigh your interests, rights and freedoms, or if the processing serves to assert, exercise or defend legal claims. If the personal data concerning you is processed for the purpose of direct advertising, you have the right to object at any time to the processing of the personal data concerning you for the purpose of such advertising; this also applies to profiling to the extent that it is connected with such direct advertising. If you object to the processing for purposes of direct marketing or profiling, the personal data concerning you will no longer be processed for these purposes.

You have the right to revoke your declaration of consent under data protection law at any time. The revocation of the consent does not affect the lawfulness of the processing carried out on the basis of the consent up until the revocation.

If you have any questions regarding your rights and the exercise of your rights, please contact the responsible body (the operator of this website, see Imprint).

4.1.9 Right to File a Complaint with a Supervisory Authority

As a data subject, without prejudice to any other administrative or judicial remedy, you have the right to complain to a data protection supervisory authority, in particular in the Member State of your domicile or where the alleged infringement took place, if you consider that the processing of your personal data does not comply with relevant data protection provisions.

The supervisory authority with which the complaint is lodged will inform you of the status and outcome of your complaint, including the possibility of a judicial remedy.
